THE STATE REGS
Proposed law: NJ Bill A3974/S3955
“Prohibits the use of deceptive marketing practices by substance use disorder treatment providers.”
The general overview of this bill includes the following:
- Treatment facilities and recovery residences will use plain language to provide clear and accurate information about types of services provided, location in which services are provided, the provider’s name/brand name and contact information, and any affiliations.
- Providers will not make misleading statements about in- or out-of-network insurance status, provide false or misleading contact information, provide false or misleading websites or redirect consumers to a false website, imply any affiliation with a provider unless there is express consent to indicate the relationship exists, or be dishonest about our geographic location.
New Jersey Administrative Code (N.J.A.C. 5.27) Subchapter 13
Definition of a Cooperative Sober Living Residence:
“Cooperative Sober Living Residences” means a residential setting that serves solely as a home for individuals who are recovering from drug or alcohol addiction and is intended to provide an environment where residents can support each other’s sobriety and recovery… a cooperative sober living residences shall satisfy the following criteria:
- Management by an entity or organization that provides an operator who shall reside in the residence and exercise some level of control over the operation of the residence and establishes the residence’s rules;
- Occupancy shall not exceed 10 individuals, exclusive of the operator;
- The requirement of the maintenance of an alcohol and drug free environment;
- No provision of on-site counseling, therapy, clinical treatment or alcohol/drug treatment by the licensee;
- No provision of food, laundry, financial or other personal services by the licensee;
- Availability of licensee, at its discretion, to provide non-clinical recovery and support services. The licensee may also elect to mandate or encourage residents to attend self-help recovery programs, participate in activities related to maintaining sobriety and continuing recovery, or receive off-site services deemed desirable or necessary to maintain sobriety;
- Ability of licensee, at its discretion, to require alcohol or drug testing of residents.
